Again, this is a case where this legislation makes a very clear distinction between those who pass and those who don’t, those who have homes and those who are homeless and even trans men and trans women. Not having public accommodations wording in this law makes it highly flawed, especially to the most vulnerable in the community. And now the media is being flooded with positive statements about how great passing this was and how Massachusetts is to be congratulated. 

Well, I don’t grant your state anything. Nevada (yes, supposed red state Nevada) just passed a totally inclusive, genuine trans rights bill which includes public accomodations, bathrooms, homeless housing, children in school situations… the real deal. While Mass, which has always had pretensions to being progressive, in 2011, passes a half-baked phony rights bill which aids those who pass and are employed. The time to rejoice over incrementalism is long past.
